MS-91-46 OF JOHN & RITA <br /> BOGGIANO (DISTRICT 4) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors deny the appeal of the Planning <br /> Commission denial of MS-91-46 . <br /> BACKGROUND: <br /> John and Rita Boggiano have applied for this subdivision to <br /> give a 3 acre parcel to their daughter, Beverly Sambado. She <br /> stated that she is involved in her parents ' farming operation <br /> and she and her husband farm many other properties. She also <br /> stated that they do not plan to build on the proposed site <br /> immediately but when their children leave, they would want a <br /> smaller home. Beverly Sambado is currently living at 8077 N. <br /> Tully Road on a 20 acre parcel that she owns . <br /> On March 1 , 1989 Minor Subdivision No. MS-89-54 was approved <br /> by staff, creating a 3-acre family member homesite parcel for <br /> their other daughter, Barbara Costigliolo, from the same parcel <br /> as in this application. <br /> On April 4 , 1991 the Planning Commission heard the request for <br /> Minor Subdivision MS-91-46 . Beverly Sambado spoke in favor of <br /> the project. A letter of opposition from John Eilers was read. <br /> It was John Eilers ' opposition that elevated this Minor Subdi- <br /> vision to a public hearing item. On a motion to approve the <br /> subdivision, the Planning Commission voted two in favor and <br /> three opposed, so the subdivision was denied. <br /> APPEAL STATEMENT: <br /> Beverly Sambado maintains in her appeal that the Planning <br /> Commission did not give any concrete reasons for their denial . <br /> She is appealing their decision to the Board of Supervisors <br /> because she feels this application meets all the requirements <br /> listed in the ordinance. <br /> BOS LETTER PAGE 1 <br />
