Failure to submit a full written report within five working days of the occurrence of the <br /> release which describes the nature and volume of the unauthorized release, any corrective or <br /> remedial actions undertaken, and any further corrective or remedial actions, including <br /> investigative actions, which will be needed to clean up the unauthorized release and abate the <br /> effects of the release and a time schedule for implementing these actions. (California Health <br /> and Safety Code 25295 (a)(1)) <br /> B. Failure to properly close an underground storage tank by not demonstrating to the local <br /> 1 agency that appropriate corrective actions have been taken. (California Health and Safety <br /> Code 25298 (c) (4) <br /> C. Violation of any applicable requirement of this chapter or any regulation adopted by the <br /> board pursuant to Section 25299.3 (California Code of Regulations Underground Storage <br /> Tank Regulations: Title 23, Division 3,Chapter 16, Article 5 Release Reporting and Initial <br /> Abatement Requirements). (California Health and Safety Code Section 25299(b)(6). <br /> L <br /> D. Failure to take corrective action in response to an unauthorized release in compliance with <br /> this section and regulations adopted pursuant to Section 25299.77(Califomia Code of <br /> Regulations Underground Storage Tank Regulations: Title 23, Division 3, Chapter 16,Article <br /> I 1 Corrective Action Requirements). (California Health and Safety Code 25299.37(a)). <br /> E. Failure to conduct corrective action that ensures protection of human health safety, and the <br /> environment. The corrective action shall be consistent with any applicable waste discharge <br /> requirements or other order issued pursuant to Division 7(commencing with Section 13000) <br /> of the Water Code, all applicable state policies for <br /> water quality control adopted pursuant to Article 3 (commencing with Section 13140) of <br /> Chapter 3 of Division 7 of the Water Code, and all applicable water quality control plans <br /> adopted pursuant to Section 13170 of the Water Code and Article 3 (commencing with <br /> Section 13240)of Chapter 4 of Division 7 of the Water Code.
