Because of the special circumstances applicable to the property, including size, shape, <br /> topography, location, or surroundings, the strict application of the zoning regulations deprives the <br />{ property of privileges enjoyed by other properties in the vicinity and under identical zoning <br /> classification. <br /> E The property's unique location, size, shape and surroundings, which consists of <br /> approximately 7.4-E acres in an AG 40 zone, containing frontage on two main roads,with 531 feet <br /> of frontage on Milton Road, and 473 feet of frontage on Copperopolis Road create the special <br /> circumstances applicable to the property. The strict application of the zoning regulation deprives <br /> the property of privileges enjoyed by other properties under identical zoning classification who have <br /> only one main road fronting the properties. Furthermore,due to its size,configuration,and location, <br /> the property's unique physical conditions are not applicable to other properties in the area and zone. <br /> 2. The granting of the Variance will not constitute a grant of special privileges inconsistent <br /> with the limitations upon other properties in the vicinity and zone in which the property is situated. <br /> Due to its unique characteristics, the subject property would enjoy no more than the <br /> privileges already enjoyed by properties in adjacent to,in the vicinity of,and in the same zone as the <br /> ' <br /> subject property. There already exist a 3f acre parcel adjacent to the property's western boundary, <br /> and two 3f acre parcels adjacent to the property's eastern boundary. <br /> Allowing the variance for the property to create two parcels, as compared to the area <br /> exceptions requiring the zoning minimum does not constitute a grant of special privileges <br /> inconsistent with the limitations upon other properties in the vicinity and zone which govern the <br /> parcel property. <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly <br /> authorized by the zone regulation governing the parcel property. <br /> The variance application is for lot size only and would not authorize a use or activity which <br /> is not otherwise expressly authorized by the regulation governing this parcel of propery <br />
