APPLICATION - VARIANCE <br /> Owner: JON B. & LINDA M. VAN TOL <br /> Address: 25517 S. Curtis Avenue <br /> Ripon, California 95366 <br /> Assessor's Parcel Number: 257-290-04 ' <br /> FINDINGS <br /> 1. Given the surrounding properties uses, the strict application of the zoning regulations <br /> deprives the VAN TOLS of privileges enjoyed by other properties in the vicinity and <br /> under identical zoning classification. Several of the surrounding properties have been <br /> divided into two similar parcels, a small parcel for a homesite and the remaining <br /> larger parcel for agricultural uses. (See Parcels 1 & 2, 19 & 20, and 21 & 22 on <br /> Assessors Map 257-29, a copy of which is attached hereto.) <br /> The VAN TOLS' property has been in their family for approximately 80 years. The <br /> VAN TOLS desire to keep the property in the family. But, for estate planning <br /> purposes, the VAN TOLS desire to transfer the agricultural portion of the property to <br /> their daughter and son-in-law, Sheri and Mark Fisher. Sheri and Mark Fisher reside <br /> in Ripon and are area farmers. Also, Mark Fisher's parents, Jerry and Mary Fisher <br /> own and farm tree crops on the real property immediately to the north of the VAN <br /> TOLS' property. Once the real property is transferred, Sheri and Mark Fisher desire <br /> to continue farming tree crops on the larger remaining parcel. <br /> 2. The proposed project does not constitute a grant of special privileges to the VAN <br /> TOLS which are inconsistent with the limitations upon other properties in the vicinity. <br /> Several of the other parcels in the area have been subdivided for similar purposes as <br /> stated above. It is intended that the uses will remain the same. <br /> 3. The variance will not authorize a use or activity which is not otherwise expressly <br /> e <br /> authorized by the zone regulation governing the parcel of property. The property <br /> is <br /> zoned AG-40. The current use of the VAN TOLS' property is for the harvesting of <br /> tree crops on the larger proposed parcel and a residence located on the smaller <br /> proposed parcel.
