CONDITIONS OF APPROVAL <br /> MS-94-6 <br /> Rudy Maggio <br /> Unless otherwise specified, all Conditions of Approval shall be compiled with prior to the approval <br /> of the Parcel Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been compiled with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Parcels 1 and 2 shall contain a minimum of 40 acres (Development Title Section 9-610.2). <br /> Parcel sizes shall be shown on the Parcel Map. <br /> b. The minimum width of the Parcels 1, 2, and the Designated Remainder shall be 330 feet <br /> (Development Title Section 9-610.4). Parcel widths shall be shown on the Parcel Map. <br /> C. Parallel to the Mokelumne River, a natural open space for riparian habitat and waterway <br /> protection shall be maintained to provide nesting and foraging habitat and the protection <br /> of waterway quality. The minimum width of said open space shall be 100 feet, measured <br /> from the mean high water level of the natural bank, or 50 feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this <br /> buffer. <br /> The mean high water level and the edge of the riparian habitat shall be shown on the <br /> Parcel Map. The open space buffer required above shall be shown on the Parcel Map <br /> with the following note: <br /> • Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this <br /> area is designated as a natural open space for riparian habitat and waterway <br /> protection. No development other than water-dependent uses shall be permitted <br /> in this space. <br /> d. If, in the course of development, concentrations of prehistoric or historic-period materials <br /> are encountered, all work in the vicinity of the find shall halt until an archaeologist can <br /> evaluate the materials and make recommendations for further action. If human remains <br /> are encountered, all work shall haft in the vicinity, and the County Coroner shall be <br /> notified immediately. At the same time, a qualified archaeologist shall be contacted to <br /> evaluate the finds. If human burials are found to be of Native American origin, steps shall <br /> be taken pursuant to Appendix K of the California Environmental Quality Act. <br /> e. Future development on the parcels shall be consistent with the requirements of the <br /> County's Tree Preservation Ordinance (Development Title Section 9-1505). <br /> Conditions of Approval - 1 - MS-94-6 <br />
