2. CHARACTER OF EASEMENTS. The easements granted in this Agreement run with, are <br /> appurtenant to and benefit the 001ninant Tenement,and shall ran with,be appurtenant to, and <br /> burden the Servient Tenement, as equitable servitudes and covenants running with the land. This <br /> Agreement shall not create arty other easements in gross for the benefit ofany other person or for <br /> the benefit of the public. The terms and conditions of this Agreement are binding upon and inure <br /> to the benefit of the successor owners of the Dominant Tenement and.the Servient Tenement and <br /> . will not be affected by merger in the event that title to the,Dominant Tenement <br /> Tenement are ever joined. and Servient <br />+� 3. DESCRIPTION OF EASEMENTS. <br /> 1 <br /> a. The easements granted in this Agreement vest Grantee with the right to discharge, <br /> Pump,or otherwise transfer and convey onto all or any part of the Servient Tenement, atty and <br /> aII dairy wastewater and wastesolids that is produced,generated, and originated from the <br /> Dominant Tenement_ <br /> l <br /> b. The easements include the following rights: <br /> i. The right to discharge and transfer dairy wastewater and wastesolids located on <br /> the Dominant Tenement to the Servient through pipelines,!�p,1� ,n a v or hereafter existin <br /> connecting the Dominant Tenement and the Servient Tenement; g' <br /> ii. The right to discharge and transfer dairy wastewater and wastesolids through any <br /> pipelines,now or hereafter existing,that deliver and transfer irrigation water throughout the <br /> Servient Tenement;and <br /> iii• The right to discharge dairy wastewater and waste solids upon and across all or <br /> any portion of the land constituting the Servient Tenement. <br /> c. Grantee shall have the right to discharge onto the Servient Tenement any and all ' <br /> wastewater and wastesolids produced on the Dominant Tenement to the extent, in the quantity <br /> and with the frequency permitted by applicable law. <br /> 4. SECONDARY EASEMENTS. Grantor hereby grants to Grantee,and Grantee's heirs, successors, <br /> and assigns,incidental rights of ingress and egress over and across the$orient Tenement to the <br /> extent necessary to use the easements described above. In exercising these rights,Grantee will <br /> use reasonable care and may not unreasonably increase the burden on the Servient Tenement. <br /> S. EXCLI75M'a'V Off'EASEMENTS. <br /> a. The easements granted in this Agreement are nonexclusive to the extent that Grantor, <br /> or Grantor's successors in interest to the Servient Tenement, may also make any use of the <br /> Servient Tenement that does not interfere unreasonably with Grantee's free use and enjoyment of <br /> the easements created hereunder. <br /> b. The easements granted hereunder are exclusive to the extent that only Grantor and <br /> Crrantce,and thcir respective heirs and successors to the Dominant Tenement and to the Servient <br /> -Z- 1 <br /> Sec ViI, A 2 <br />
