1 <br /> r <br /> CONDITIONS OF APPROVAL <br /> PA-1700199 <br /> RANDY C. &ARLENE SASAKI ROGETIQUARTAROLI&ASSOCIATES <br /> Minor Subdivision Application No. PA-1700199 was approved by the Community Development <br /> Department on November 29, 2017. The effective date of approval is December 9, 2017.This tentative <br /> map approval will expire on December 8, 2020, which is three (3) years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Contact Staff: Megan Aguirre, (209)468-3144) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated September 12, 2017. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a separate instrument: <br /> (1) All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH:The following lot size and width regulations shall apply to this map: <br /> (1) Parcel One shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> (2) Parcel One shall be between two (2) gross acres and five (5) gross acres in size. (Development <br /> Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION: A note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (1) The home site (Parcel One) shall not be transferred until December 9. 2027, or upon the death <br /> of an owner owning at least fifty (50) percent interest in the homesite parcel, unless the homesite <br /> parcel and the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivision for homesite <br /> purposes, except for financing only, by Section 9-610.3 of the San Joaquin County Development <br /> Title. <br /> e. BUILDING PERMIT: The owner shall obtain a building permit for a single family dwelling for each <br /> homesite parcel concurrently with the approval of the parcel map. (Development Title Section 9- <br /> 610.3[a][4]) <br /> f. TREE PRESERVATION: Future development on the parcels(s) shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance(Development Title Section 9-1505.2). <br /> PA-1700199 (MS) Conditions of Approval 1 <br />
