e. PROPERTY LINE SETBACK: The following requirement shall apply: <br /> (1) The proposed new property lines for Parcel 1 shall meet the side and rear setback <br /> requirements for the AG-40 (General Agriculture, 40-acre minimum) zoning <br /> designation. (Development Title Table 9-610.2) <br /> f. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until (10 years from the date of approval), or <br /> upon the death of an owner owning at least fifty (50) percent interest in the homesite <br /> parcel, unless the homesite parcel and the remainder parcel are merged pursuant to <br /> the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivision for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San Joaquin <br /> County Development Title. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or proceeding against the local agency or <br /> its agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section 66499.37 of the Government Code <br /> I DEPARTMENT OF PUBLIC WORKS (Staff contact: Alex Chetley, (209) 468-3000, see <br /> memo dated December 28, 2012) <br /> 4.
