CONDITIONS OF APPROVAL PA-1000094 Sizuela Minor Subdivision; Application No. PA-1000094 was approved by the San Joaquin County Community Development Department on June 17, 2010. The effective date of approval is June 27, 2010. This tentative map approval will expire on June 26, 2013, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of;the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and otEier Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson, 209-468-9653) a. TENTATIVEMAP: The Parcel Map shall substantially conforms with the approved tentative map dated April 29, 2010. b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall be placed on the Parcel Map and recorded as a separate instrument: (1) All perso.6s purchasing lots within the boundaries of this approved map should be prepared to accept the inconveniences or discomforts associated with agricultural operations or activities, such as poise, odors, insects, dust or fumes. San Joaquin County has determined that such inconvenioncies or discomforts shall not be considered to be a nuisance. c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to,this map: (1) Parcels 1-shall have a minimum lot width of 330 feet, measured at the front yard setback line. (Development Title Section 9-610.4) (2) Parcels 1°shall be between two(2) net acres and five(5)gross acres in size. (Development Title Section 6=610.3[a](2)) d. TRANSFERtESTRICTION FOR PARCEL 1: A Note shall be placed on the Parcel Map and a Notice of Minor Subdivision Restriction shall be recorded for Parcel 1 concurrently with the Parcel Map,with a reference to the instrument number of said recorded notice, stating that: (1) The homesite shall not be transferred until June 27, 2020, or upon the death of;an owner owning at least fifty (50) percent interest in the homesite parcel, unless the homesite,parcel and the remainder parcel are merged pursuant to the provisions of the Development Title. (2) The property shown on the Parcel Map is restricted from further subdivisions for homesite;purposes, except for financing only, by Section 9-610.3 of the San ,Joaquin County Development Title. e. NOTICE OF ,NON-RENEWAL: A Notice of Non-renewal for all parcels below the ken (10)acre minimum parcel size will be required in conjunction with the contract.
