CONDITIONS OF APPROVAL <br /> PA-1300027 & PA-1300066 <br /> Silray Incorporated <br /> Site Approval application No. PA-1300027 & PA-1300066 was approved by the San Joaquin County <br /> Community Development Department on April 17, 2014. The effective date of approval is April 27, <br /> 2014. This approval will expire on October 27, 2017 October 27, 2015, which is 18 months from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with, (2) all <br /> necessary building permits have been secured and remain in force, and (3) all necessary permits <br /> from other agencies have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Stephanie Stowers [209] 468-9653) <br /> a. BUILDING PERMIT: Submit an ''APPLICATION-COMMERCIAL BUILDING PERMIT". The Site <br /> Plan required as a part of the building permit must be prepared by a registered civil engineer or <br /> licensed architect. This Plan must show drainage, driveway access details including gates, on- <br /> site parking, landscaping, signs, existing and proposed utility services, and grading (refer to the <br /> "SITE PLAN CHECK LIST" for details). Foundation and soils investigation shall be conducted in <br /> conformance with Chapter 18 of the California Building Code at the time of permit application. A <br /> fee is required for the Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED USE: This approval is to construct a 2.0-megawatt solar power facility <br /> encompassing 15.00 acres in two phases over five years as shown on the Site Plan dated <br /> February 14, 2013. Phase One (building permits to be issued within eighteen (18) months from <br /> the effective date of approval) consists of the development of 10.00 acres on APN: 187-180-11, to <br /> include a switchyard, 40" by 60" solar panels, inverter panels, and combiner boxes. Phase Two <br /> (building permits to be issued within five (5) years from the effective date of approval consists of <br /> the expansion to an additional 5.00 acres on APN: 187-180-10, to include the expansion of the <br /> switchyard, additional solar panels, inverter panels, and combiner boxes. At full buildout, the <br /> project will encompass 15.00 acres of two parcels totaling 164.07 acres. (Use Type: Utility <br /> Services- Major) <br /> c. CAPITAL FACILITY FEE: This project may be subject to the Capital Facility Fee. If the Capital <br /> Facility Fee is applicable, the County shall collect the fees before the issuance of any building <br /> permits. (Development Title Section 9-1245.2) <br /> d. SCREENING: The solar arrays and all storage materials and related activities, including storage <br /> areas for trash, shall be enclosed by a screen six (6) to eight (8) feet in height. (Development Title <br /> Section 9-1022.4[e][2][A]) <br /> e. REMOVAL OF FACILITIES: Freestanding structures, solar arrays, and supporting equipment <br /> associated with photovoltaic electric generation shall be removed by the provider of such facilities <br /> and the site restored to its pre-construction state if said facilities have not been operational or <br /> used for a period of six (6) consecutive months. Removal and site restoration shall be completed <br /> within ninety (90) days of the end of said six (6) month period. <br /> f. SOLAR-USE EASEMENT: Prior to the issuance of building permits, the applicant shall rescind <br /> the Williamson Act Contract and enter into a Solar-Use Easement or apply for and obtain approval <br />
