Solar-Use Easement <br /> January 31, 2013 <br /> Page 5 of 5 <br /> Nothing shall limit the power of the state or any county, city, school district, or any other local public district, <br /> agency, or entity, or any other person authorized by law, to acquire land subject to a solar-use easement by <br /> eminent domain. <br /> Per Government Code §51191.6, upon the acceptance or approval of any instrument creating a solar-use <br /> easement, the clerk of the governing body shall record the instrument in the office of the county recorder and <br /> file a copy with the county assessor. After the easement is recorded, it shall impart notice to all persons under <br /> the recording laws of this state. <br /> Per Government Code §5119.7, the parcel(s) subject to a solar-use easement shall be assessed pursuant to <br /> Section 402.1 of the Revenue and Taxation Code during the term of the easement. <br /> Please provide our office with a copy of the written agreement regarding the restoration security prior to <br /> recordation of the easement, and a copy of the signed Easement Agreement aand recorded Resolution for the <br /> Solar-Use Easement within 30 days of approval. Once rescission fees are collected, they shall be transmitted <br /> by the County Treasurer to the State Controller's office. The funds collected by the County shall be sent to the <br /> State Controller within 30 days of the approval by the board or council.
