to cancel the Williamson Act Contract. Filing fees are required for these applications. <br /> (Government Code Sections 51255.1, 51190, 51 191) <br /> g. PERFORMANCE GUARANTEE: In order to ensure reclamation of the site, compliance with the <br /> solar-use easement, and compliance with Community Development Department and Department <br /> of Conservation regulations, the applicant shall provide a performance guarantee prior to issuance <br /> of the Building Permit. The performance guarantee shall be in the form of either: 1) a surety <br /> bond, 2) a trust fund with the lead agency, or 3) an irrevocable letter of credit. Any interest <br /> accrued in a trust fund shall stay with the trust fund account. The financial guarantee shall be <br /> payable to "San Joaquin County and the Department of Conservation" under the applicable <br /> provisions of the County and Department of Conservation regulations. The financial guarantee <br /> shall be callable by the County or the State under the following circumstances. <br /> (1) The applicant files for bankruptcy, <br /> (2) There arises an occurrence or circumstance which, in the opinion of the County or State, <br /> jeopardizes the site reclamation; or <br /> (3) In any instance that the County or State makes the demand for partial or full tender of the <br /> financial guarantee of performance, the County and/or state may use all or any portion of the <br /> financial guarantee to reclaim the site and to recover its administrative costs associated <br /> therewith. <br /> h. HABITAT CONSERVATION PLAN: The applicant shall participate in the San Joaquin County <br /> Multi-Species Habitat Conservation and Open Space Plan (SJMSCP) or provide alternative <br /> mitigation in an amount and kind equal to that provided in the SJMSCP. Consultation with US <br /> Fish and Wildlife, CA Fish and Wildlife, and US Army Corps of Engineers is required to provide <br /> alternative mitigation and/or for permitting requirements. <br /> i. BUILDING DEPARTMENT REQUIREMENTS: The following California Building Code (CBC) and <br /> San Joaquin County Ordinance requirements will be applicable and shall be incorporated in the <br /> construction plans before submittal to the Building Inspection Division: <br /> (1) The proposed project will require plans prepared by a registered engineer or licensed <br /> architect and shall be submitted for review and approval and show the following: <br /> a) Any electrical, plumbing or mechanical work necessary to install the proposed equipment <br /> including any structures both site built and pre-manufactured. <br /> b) Support and anchorage of solar panels and rack system. <br /> c) Geotechnical report and site grading analysis. <br /> 2. CALIFORNIA DEPARTMENT OF FISH AND WILDLIFE (Staff Contact: Todd Gardner, [209) 745- <br /> 1968, see email dated March 11, 2014) <br /> a. In order to avoid take (FGC § 86) of protected raptors (FGC § 3503.5), a pre-construction raptor <br /> nest survey shall be conducted within a quarter-mile (1320 feet) of the project site, and within 15 <br /> days prior to the beginning of construction activities by a California Department of Fish and <br /> Wildlife (CDFW) approved biologist in order to identify active nests in the project site vicinity. The <br /> results of the survey shall be submitted to San Joaquin County Community Development <br /> Department and the CDFW. <br /> b. If active nests are found, a quarter-mile initial temporary nest disturbance buffer shall be <br /> established. If project related activities within the temporary nest disturbance buffer are <br /> determined to be necessary during the nesting season, then an on-site biologist/monitor <br />
