the properties in the i icinity and zone. Stockton East Water District canal is a winding watercourse that <br /> traverses over numerous parcels within the project vicinity. It appears the parcels to the west and south of <br /> the project site are impacted by the canal as well. The surrounding parcels which are consistent with the <br /> zone minimum in size have the same zone classification and General Plan designation as the project site. <br /> Finding Three: Use Authorized <br /> The Variance will nbt authorize a use or activity which is not otherwise expressly authorized by <br /> the regulation governing the parcel of property, <br /> Applicant's Statement: <br /> "This finding'0n be made because the Variance application is for parcel size only and will not <br /> constitute an_approval for uses other than those based on the zoning regulations that it falls <br /> under." <br /> This finding can be made because the Variance application does not authorize a use that is not otherwise <br /> expressly authorized-.by the General Plan or Development Title. Residential and agricultural uses are <br /> permitted in the AIG{General Agriculture) General Plan designation and in the AG-160 zone. The parcel <br /> is currently used for agriculture. <br /> Williamson Act Com atibilit Principles <br /> The project site is currently under California Land Conservation Contract No.70-CI-130"-- or the purposes <br /> of Williamson Act coianpatibility, agricultural land shall be presumed to be in parcels large enough to <br /> sustain their agricultural use if the land is at least 1.0 acres in size in the case of prime agricultural land, or <br /> at least 40 acres in size in the case of land which is not prime agricultural land. According to the San <br /> Joaquin County Soil,Survey Classification, the project site soil is classified as"Peters Clay" (2-8 percent <br /> slopes), "Redding gravelly loam" (2-8 percent slopes), and "Redding gravelly loam (8-30 percent slopes). <br /> These soil types typically consist of dark gray to dark brown clay and brown and yellow reddish gravelly <br /> loam. The map unit for"Peters Clay" is in capability class Vie (MRLA-18), non_irrigated, "Redding gravelly <br /> loam" (2-8 percent) i in capability unit lVe-3 (MRLA-17), irrigated and non-irrigated. "Redding gravelly <br /> loam (8-30 percent) is in capability unit IVe-3 (MRLA-17), non-irrigated. The Storie indexes of the soils <br /> are 17, 15, and 12 respectively. The project site may not be considered prime farmland under this <br /> guideline. Thus, the'ereation of a 10.20-acre parcel classified as non-prime farmland may be inconsistent <br /> with the Williamson Act Compatibility Principles. However, because the project site is planted in <br /> vineyards, the applicant may be able to establish the proposed site as prime farmland under Government <br /> Code Section 51200(4). Government Code Section 51200(4) states: "Land planted with fruit or nut <br /> bearing trees, vines, bushes, or crops which have a nonbearing period of five (5)years and which will <br /> normally return during the commercial bearing period on an annual basis from the production of <br /> unprocessed agricultural plant production not less than two hundred dollars ($200.00) per acre." The <br /> applicant must meet;Pe principle to qualify as prime farmland under this Government Code Section. <br /> Minor Subdivision <br /> If the Variance application is approved, the applicant will need to submit a Minor Subdivision application <br /> to the Community Development Department to subdivide the property.
