Because of the special circumstances applicable to the property, including size, shape, <br /> topography, location or surroundings, the strict application of the zoning regulations <br /> deprives the property of privileges enjoyed by other properties in the vicinity and under <br /> identical zoning classification. ! <br /> • Due to the size of the property, the location of the Stockton East Water District <br /> Canal, and accessibility issues with planting and harvesting equipment, it is <br /> prohibitive for the owner to plant in this area. The strict application of the <br /> zoning regulations deprives the owner of a substantial amount of agricultural <br /> area that can be utilized. Other owners are not encumbered by this situation and <br /> enjoy the ability to plant and harvest the full extent of their respective properties. <br /> 2. The granting of the variance will not constitute a grant of special privileges inconsistent <br /> with the limitations upon other properties in the vicinity and zone in which the property is <br /> situated. . <br /> • The granting of the Variance will not confer a special privilege as other property <br /> owners do not have the same encumbrances, i.e., due to the Stockton East Water <br /> District Canal separating a portion of their parcels from the main portion. <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly <br /> authorized by the zone regulation governing the parcel property. <br /> • This finding can be made because the Variance application is for parcel size only <br /> and will not constitute an approval for uses other than those based on the zoning <br /> regulations that it falls under. <br /> 1 <br /> 1 s <br />
