Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Corinne King;953=7509) a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The property descriptions submitted with the Certificate of Compliance application shall substantially conform with the approved revised tentative map dated July 25, 2007. A fee is required to process � the Certificate of Compliance application (Development Title Section 9-890.4)., b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall be recorded as a separate instrument with the Certificate of Compliance: (1) All persons purchasing lots within the boundaries of this approved-map should be prepared to 1 accept the inconveniences or discomforts associated with agricultural operations or activities, I such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such inconveniencies or discomforts shall not be considered to be a nuisance. c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: (1) All Parcels shall have a minimum lot width of 330 feet(Development Title Section 9-610.4) (2) All Parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) 2. COUNTY COUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code 3 DEPARTMENT OF PUBLIC WORKS (See attached memo dated September 10, 2007). 4.
