Subsequent removal of adjacent
lands from agricultural-use-appears not likely to result-from this removal of the`homesite.
However, the Department, has concern that homesite removal may result in:-the,
remaining7contracted: land being in conflict with minimum parcel size requirements for:
Williamson .Act contract.eligibility. Thus, the Department recommends the Board
consider nonrenewal of the remainder parcel as condition to their cancellation
approval.
(3) Alternative use is consistent with County's General Plan:
The proposed alternative use appears to be consistent with San Joaquin County
General Plan. Creation of a retained homesite parcel is allowed within designated
agricultural.areas, consistent with AIG (General.Agriculture) General Plan designation,
wrtich stafas a residential:density at a rp,aximum-of.one primary r slderc—per.29acres.
(4) Discontiguous patterns of urban development will not result:
Based on the information provided, the Department agrees with the determination that
discontiguous patterns of urban development are not likely to occur.
The Department, however, recommends that any additional information regarding the
intent and ability of the intervening landowners to develop their land be added to the
record.
