M. Order No..R5-2009-0097 - 18 - Conditional Waiver of Waste Discharge'Requirements for Small Food Processors and Small Wineries Within the Central Valley Region 4. A copy of this Order and the Notice of Applicability shall be kept at the facility for reference by operating personnel. Key operating and site management personnel must be familiar with the documents: 5. The Report of Waste Discharge, monitoring reports, and any other information requested bythe Central Valley Water Board shall be signed as follows: a. Fora corporation: by a principal executive officer of at least the level of senior vice-president or a duly authorized representative of that person. b. For a partnership or sole proprietorship, by a general partner or the proprietor or a duly authorized representative of that person-. c. For a municipality or public agency_ by either a principal executive officer or ranking elected or appointed official or a duly authorized representative of that person. 6. Any person signing a Report of Waste Discharge, monitoring report, or-other technical report makes the following certification whether written or m l,ied: _ , "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry,of.the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete- am aware that there are significant penalties for submitting false information, including the possibility of fine andimprisonment for knowing violations." 7. All technical and monitoring reports submitted pursuant to this Waiver are required pursuant to CWC Section 13267. Failure to submit reports in accordance with schedules established by this Waiver_, the attachments of this Waiver, or failure to submit a report of sufficient technical quality to be acceptable to the Executive Officer, may subject the Discharger to enforcement action pursuant to CWC Section 13268. 8. This waiver is not transferable. In the event_of any change in control or ownership of land or waste discharge facilities presently owned or controlled by the Discharger, the Discharger shall notify the succeeding owner or operator of the existence of this Waiver by letter and shall inform the new owner or operator of the requirement-to submit a Report of Waste Discharge at least 120 days before commencing operation of the facility. A copy of the letter shall be immediately forwarded to the Executive Officer. 9. In the event that the Discharger does not comply, or will be unable to comply, with any conditions of this Order, the Discharger,shall notify Central Valley Water Board staff by telephone as soon as it or its agents have knowledge of such
