S . ! ] 1 <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Corhmission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve a one-year Time Extension for Use Permit Application No. PA-0400180 with the <br /> Previously approved Findings and Conditions of Approval contained in the staff report. <br /> Previously Approved Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Pian, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the use type Wineries &Wine Cellars, Winery-Medium <br /> may be conditionally permitted in the AG-40 zone with an approved Use Permit <br /> application. There are no Master Plans, Specific Plans or Special Purpose Plans in the <br /> project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the Environmental Health Department is requiring that <br /> the applicant continuously post public notification regarding the above maximum <br /> contaminant level for nitrates for water being utilized at the facility. In addition, EHD is <br /> requiring that the applicant provide documentation that states that the City of Lodi or <br /> another approved winery waste disposal facility will accept the additional winery waste <br /> k generated by the expansion of the winery. The Department of Public Works is requiring <br /> II that the applicant pay Traffic Impact Fees which are calculated based on the total square <br /> footage of the new building. All other conditions of approval satisfied by the previous Use <br /> Permit(UP-01-08) provided necessary sanitation,water supply, drainage and roadway <br /> improvements. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the 20.72 acre parcel is of adequate size for the type <br /> and intensity of development. Approximately 1.5 acres will be developed and the <br /> remainder is planted in vineyards. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because the Initial Study prepared for this project found no <br /> potentially significant environmental impacts that could not be mitigated to a less than <br /> significant level. <br /> C) San Joaquin County PA-040018MLockeford Winery <br /> Community Development Page 4 <br /> F <br />
