The District currently has available water and sewer capacity and <br /> facilities to serve this commercial development, subject to compliance with applicable <br /> District ordinances, resolutions and regulations. <br /> This will-serve commitment is effective only if the following criteria are met: <br /> 1)Execution of a mainline extension agreement between Lockeford CSD and Diede <br /> Construction for the commercial development,which shall include, but not be limited to, <br /> the construction by Diede Construction of all sewer and water mains and related facilities <br /> to serve this commercial development. <br /> 2)Pull payment of sewer and water connection fee's(amount to be determined) at the <br /> time of execution of mainline extension agreement between Lockeford CSD and Diede <br /> Construction. <br /> 3) The developer, Diede Construction Inc. to deposit a developer fee of$10,000 with the <br /> Lockeford CSD to cover engineering and legal fee's incurred by the District during this <br /> proiecc. <br /> 4) A final map for this project is recorded within three years from the date of this letter. <br /> Thereafter,this will-serve commitment shall terminate and become null and void. <br /> This will-serve commitment shall terminate and become null and void upon written <br /> notice frorn the District to the owner or developer at the above listed address that the <br /> owner or developer has failed to comply with any provision of the District ordinances, <br /> resolutions or regulations. <br /> Sincerely, <br /> I <br /> Joseph Sal an <br /> District Manager <br /> t rcr) <br />
