because San Joaquin County is a signatory to the San Joaquin County Multi-Species Habitat <br /> Conservation and Open Space Plan (SJMSCP), participation in the SJMSCP satisfies requirements of <br /> both the state and federal endangered species acts, and ensures that the impacts are mitigated below a <br /> level of significance in compliance with the California Environmental Quality Act. The applicant has <br /> stated a desire to participate in the SJMSCP. A biologist will review the site to determine if there would <br /> be any impacts to the Valley Elderberry Beetle, and if so, appropriate mitigation measures would be <br /> implemented as part of-the applicant's participation in the SJMSCP. <br /> Oak Trees <br /> There are a number of Heritage Oak Trees and Native Oak Trees on this property. The applicant is <br /> proposing to preserve all of these existing trees for the Major Subdivision. In order to protect and <br /> preserve the Heritage Oak Trees and Native Oak Trees from development and construction activity, the <br /> following standards shall be applicable to the project regarding grade changes, fencing around the trees, <br /> trenching activities, and paving (Development Title Section 9-1505.5). <br /> No grade changes shall occur within six (6)feet of the trunk of the tree. <br /> • No grade changes shall occur that entail removing or adding more than six (6) inches of soil in the <br /> protected zone of the tree. <br /> • Extensive cuts or fills that are necessary beyond the protected zone shall have adequate drainage to <br /> mitigate adverse effects caused by changes in grade elevation. <br /> • Any grade changes within the protected zone of the tree shall be accomplished so as to prevent soil <br /> compaction and injury to or removal of the tree's roots. <br /> Before radin_9 op <br /> g_ _ erations - . ay commence, a minimum five (5)_foot high chain_link fence_or_ot_er_ _ <br /> — __ m <br /> r - comparable protective fencing shall be installed at the outermost edge of the protected zone of each <br /> 1 tree or group of trees. F <br /> Fences shall remain in place throughout the entire construction period. <br /> No material, machinery, or objects of any kind may be stored within the fenced area. <br /> • No trenching shall be allowed within the protected zone of subject trees. <br /> Paving within the dripline of affected trees shall be stringently minimized. If paving is necessary, <br /> porous materials such as gravel, loose boulders, and cobbles, brick with sand joints, wood chips, or <br /> bark mulch shall be used. <br /> Caltrans <br /> On May 4, 2004, Lynn O'Connor at Caltrans indicated that the letter of April 22, 2004 was for information <br /> only. The applicant will still be required to obtain an Encroachment Permit for work done within the State <br /> right of way. After discussions with Tom Dumas, Chief of the Office of Intermodal Planning, Caltrans <br /> determined that, with a subdivision of 15 lots, there would be no need to conduct a Traffic Impact Study <br /> since the traffic generated would be of a less than significant impact. The environmental issues discussed <br /> by Caltrans, if applicable to the project,were addressed in the Initial Study. <br /> The elderberry bushes located on the project site are not near the Caltrans right of way.
