The District currently has available water and sewer capacity and <br /> i facilities to serve this commercial development,(mini storage, gas station-fast food, <br /> F + icable District ordinances, resolutions, riles <br /> warehouse) subjeci to compliance with appl <br /> and regulations. <br /> This ( conditional ) will serve letter is further subject to the following: <br /> 1) Execution by the District and Diede Construction of a mainline extension <br /> agreement for the commercial development and Diede Construction's full <br /> satisfaction of the terms of that agreement, which shall include, but not be limited <br /> to, the construction by Diede Construction of water and sewer mains and related <br /> facilities to serve the commercial development. <br /> 2) The District's consent to the transfer of between 9 and 19 will-serve credits <br /> currently owned by JS Properties Inc. CUM') to Diede Constriction and Diede <br /> Construction's filing with the District of proof, in a form satisfactory to the <br /> District, of Diede Construction's purchase of between 9 and 19 of JSA's will- <br /> serve credits. <br /> 31 The developer(beide Construction Inc.)to deposit a developers fee of$10,000 <br /> with the District (LCSD) to cover engineering and legal fee's incurred by the <br /> 1 District during this project. <br /> This will serve commitment is effective only if a final map or maps for the entire <br /> pro'erty is (are) recorded withinthree years from the date of this letter. Thereafter, this <br /> li will serve !etter shall terminate and become null and void. <br />
