As you also know, I have no culpability in this action whatsoever. <br /> Unfortunately, I must defend myself against this frivolous lawsuit and I am requesting the <br /> assistance of EHD. <br /> I have been accused of improper design of the septic system for the referenced facility. I am <br /> specifically requesting a letter from EHD, with your approval and Ms. Heran's approval, <br /> documenting that I complied with all of the requirements of EHD, as summarized by the <br /> following: <br /> • Infiltrator Chambers were required to be installed to minimize the nitrate ztrate loadin <br /> g <br /> potential, and maximize the denitrification potential. <br /> • Conventional leachlines and seepage pits were specified which were designed as a safety <br /> factor in the event of chamber problems or failure. Because of this safety factor, the <br /> system was enlarged and "over-designed." <br /> • The plaintiff was required to purchase additional land for reserve/replacement area in the <br /> event of problems or failure. The plaintiff has failed to activate this reserve area under <br /> EDHpermit: -- � ._� .,.._ <br /> Thank you for attention to this matter.
