The <br /> facility is regulated by Waste Discharge Requirements(WDRs) Order No. 115-20040034. The WDRs <br /> provisions require the Discharger to submit certain technical and monitoring reports.Those reports are <br /> required pursuant to Section 13267 of the California Water Code. A copy of the WDRs are enclosed for <br /> your'information. Staff has not received the following reports: <br /> 1. Provision F_La required submittal of a report certifying the new wastewater systern has bee <br /> constructed as described prior to:initiating discharge. The report has not been received and the <br /> discharge has begun. The report was required to ensure adequate wastewater treatment capacity <br /> exists prior to the initiation of business activities at the site. A 2 December 2004 telephone call <br /> ✓ to the Clements facility revealed that chocolate manufacturing has been performed there since <br /> May 2004. Please refer to the WDRs for further description of the report. <br /> 2. Provision F.Lb required submittal of an Operation and Maintenance Plan(O&M Plan)by <br /> 17 July 2004. The report has not been received_ The report shall instruct personnel on how to <br /> manage the day-to-day discharge operations to comply with the WDRs. Please refer to the <br /> WDRs for further description of the report. ' <br /> 3. Provision F.3 requires compliance with the Monitoring and Reporting Program(MRP)No. R5- <br /> 2004-0034,and any revisions thereto as ordered by the Executive Officer. Monitoring reports <br /> have not been received since the WDRs were adopted. Monitoring reports should have been J <br /> prepared beginning in the month of May or June 2004.
