Box 730 <br /> 1019 E_.'Righway 88,x.. <br /> Clements, CA 95227 <br /> NOTICE OF VIOLA TION FAIL URE TOS SUBMIT MIT TECHNICAL AND MONITORING REPORTS, <br /> SCHENONE SPECIALTY FOODS, INC., SAN JOAQUIN COUNTY <br /> Ernie and Mary Schenone (hereafter Discharger) own and operate Schenone Specialty Foods, Inc. The <br /> facility is regulated by Waste Discharge Requirements (WDRs) Order No. R5-2004-0034. The WDRs <br /> provisions require the Discharger to submit certain technical and monitoring reports. Those reports are <br /> required pursuant to Seetion 13267 of the California Water Code. A copy of the WDRs are enclosed for <br /> -your information. Staff has not recLved the following reports:-- <br /> 1. Provision F.La required submittal of a report certifying the new wastewater system has been <br /> constructed as described prior to'initiating discharge. The report has not been received and the <br /> discharge has begun. The report was required to ensure adequate wastewater treatment capacity <br /> exists prior to the initiation of business activities at the site. A 2 December 2004 telephone call <br /> to the Clements facility revealed that chocolate manufacturing has been performed there since <br /> May 2004'. Please refer to the WDRs. for further description of the report. <br /> 2. Provision F.Lb required submittal of an Operation and Maintenance Plan (O&M Plan) by <br /> 17 July 2004. The report has not been received. The report shall instruct personnel on how to <br /> manage the day-to-day discharge operations to comply with the WDRs. Please refer to the <br /> WDRs for further description of the report. <br /> 3. Provision F.3 requires compliance with the Monitoring and Reporting Program (MRP) No. R5- <br /> 2004-00;4, and any revisions thereto as ordered by the Executive Officer. Monitoring reports <br /> have not been received since the WDRs were adopted. Monitoring reports should have been <br /> prepared beginning in the month of May or June 2004. Please refer to the MRP for monitoring. <br /> and reporting requirements. <br /> The WDRs require that all monitoring and technical reports be submitted pursuant to Water Code <br /> Section 13267, which states, in part: <br /> "In conducting an investigation specified in subdivision (a), the regional board,-nay require <br /> that any person who has discharged, discharges, or is suspected of having discharged or <br /> California Environmental Protection Agency <br /> �a Recycled Paper <br />
