Can you please explain why your department has taken this hands-off approach to my <br /> project? <br /> The CVRWQCB has regulatory and enforcement authority for all discharges of waste <br /> to land, including both surface and subsurface discharge of wastewater,that could <br /> affect the waters of the state.E� The EHD has regulatory and enforcement responsibility <br /> under the San Joaquin County Development Title for on-site wastewater disposal <br /> systems for domestic sewage (septic systems) and is charged with ensuring that all <br /> wastewater discharge to land is at least as stringent as and not in conflict with discharge <br /> requirements set by the CVRWQCB.12 The EHD has not taken a"hand-off' approach <br /> to your project; however, due to the nature of your operation, the EHD trust defer to <br /> the CVRWQCB to set your WDRs. Once those conditions are established,the EHD <br /> has a responsibility to make sure your operation is in compliance with them <br /> b. Can you please explain what, if any, support I can expect from San Joaquin County EHD? <br /> As previously noted,the EHD will continue to communicate,coordinate and attend <br /> I meetings with you and the CVRWQCB concerning your project. <br /> The EHD will oversee and conduct field inspection(s)of the installation of the <br /> Alternative/Engineered Septic System and review monitoring data and perform_roufine <br /> inspections of your disposal system. Additionally, the department will review ypur <br /> food facility plans and conduct construction and routine inspections for the retail food <br /> operation at the site. <br /> c. As you are aware the Regional Board has never responded to[any]my specific requests <br /> for clarification of our waste system design. How therefore am I to build and operate our. <br /> facility if the Regional Board does not address our questions and San Joaquin County EHD <br /> is no longer involved? <br /> The EHD is in receipt of correspondence sent to you by the CVRWQCB on May 30th <br /> and June 5`h,which state that you are required to submit a RWD which includes a <br /> technical report prepared by a California registered engineer,and that this information <br /> will be used to establish the WDRs for your facility. The EHD staff will continue to <br /> work with both you and the CVRWQCB staff to ensure that this project meets the State <br /> requirements, is protective of the groundwater, and meets the needs of your operation. <br /> d. Can you provide any assistance or guidance in dealing with the regional board? I am <br /> having a difficult time complying with their requests far "additional information." <br /> Building permits were issued, and construction of our project has begun based on a letter <br /> addressed to Mr.Huggins dated 05 May 2002 (NOTE; the actual date[was]of letter.is 05 <br /> May 2003), which is attached. Please note the "blank check clause"in the 2"d paragraph <br /> which states, <br /> - n can move <br /> As discussed, we agree that the County onward with its f <br /> permitting process, contingent upon the fact that the applicant(Mr. <br /> Schenone,Jr.)respond to any Regional Board requests for additional <br /> information in a timely manner and that he comply with any WDRs <br /> issued by the Regional Board. <br /> As noted previously, the CVRWQCB has regulatory authority for establishing criteria <br /> for waste discharge to land.
