The project site is located on the south side of,State Route 88, 800 feet <br /> east of Mackville Road, in Clements. Our Encroachment Permit Branch has reviewed the above <br /> referenced application and offers the following comments: <br /> In February 1997, Mr. Lukas built concrete curbed landscape planters in State right of <br /> way prior to the reopening of the aforementioned restaurant. Mr. Lukas was informed of his <br /> illegal encroachment and continued to expand the unauthorized work. To date Mr. Lukas has not <br /> removed the illegal encroachment. <br /> • Caltrans request that all of the illegal encroachment facilities be removed from State right <br /> of way. This includes the concrete curb, decorative rocks, signs and lights. The original <br /> site plan and the current site approval application do not show the aforementioned work <br /> in State right of way. Additionally, the site plan shows a monument type advertising sign <br /> five (5) feet back from property line. Portions of this existing sign are on State right of <br /> way. <br /> • The Site plan submitted for this review also seems to show trees at the edge of property <br /> line adjacent to the highway. Landscaping will not be allowed in State right of way. <br /> 609540 <br />
