SEIBEL OF THE PLANNING COMMISSION' S <br /> DENIAL OF MINOR SUBDIVISION APPLICATION NO. MS-91-78 OF <br /> LOIS MEIER (C/O MONTE SEIBEL) (DISTRICT 4) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors deny the appeal and uphold the <br /> Planning Commission' s action to deny Minor Subdivision No. <br /> MS-91-78 . <br /> BACKGROUND: <br /> On February 25, 1986, the Planning Division approved Minor <br /> Subdivision No. MS-86-48 subject to the condition that the access <br /> road be improved to public roadway standards. This subdivision <br /> created four 20-acre parcels including the subject property (see <br /> page 26) . A condition requiring the improvement of the access road <br /> to public roadway standards was appealed. On April 17 , 1986 the <br /> Planning Commission denied the appeal and modified some of the <br /> conditions of approval. The Planning Commission ' s denial was <br /> appealed to the Board of Supervisors. On May 22 , 1986 , the Board <br /> of Supervisors approved the appeal to remove the condition that the <br /> road be built to public road. <br /> On February 27 , 1991, Lois Meier applied for this Minor Subdivision <br /> (MS-91-78) to create a 2 . 0 acre owner-operator homesite parcel on <br /> a private road. The Development Services Division denied this <br /> application because the proposal is in conflict with Board <br /> Resolution No. R-88-1200. That resolution does not allow the <br /> creation of a parcel to be served by a private right of way if that <br /> right of way is already serving six or more parcels. The right of <br /> way currently serves as access to eight existing parcels. <br /> On May 6, 1991, Lois Meier (c/o Monte Seibel) appealed the <br /> Development Services Division' s action to deny to the Planning <br /> Commission. <br /> ROS PACE.
