The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated nonattainment to reduce emissions until standards are met. Based on the information provided, this project will have a less-than-significant impact on the ambient air quality. Therefore, a negative declaration is appropriate from an air quality perspective. However, the construction phase of this project can generate emission from the movement of soil, use of heavy equipment, bulk materials handling, i asphalt paving and other related activities. As a result, this project is subject to District Regulation Vill (Fugitive Dust Prohibitions). The purpose of Regulation Vlll is to reduce the amount of fine particulate matter (PM-10) entrained into the ambient air from man- made sources. The attached Synopsis highlights many of the requirements contained within Regulation Vlll. The Synopsis is not meant to be all inclusive, but it can be a useful compliance aid in the field and office alike. An Authority To Construct (ATC), Permit To Operate (PTO) or a modification to an existing permit may be required. The applicant is advised to contact the Permit Services Division to obtain appropriate approvals prior to construction. David L.
