(1) The homesite shall not be transferred until November 1, 2020, or upon the death of an owner <br /> owning at least fifty(50) percent interest in the homesite parcel, unless the homesite parcel and <br /> the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivision for homesite <br /> purposes; except for financing only, by Section 9-610.3 of the San Joaquin County Development <br /> Title. <br /> ,0 <br /> g. RIPARIAN HABITAT: Parallel to Calaveras River along the Designated Remainder parcel, a <br /> natural open--,space area for riparian habitat and waterway protection shall be maintained to <br /> provide nestOg and foraging habitat and the protection of waterway quality. The minimum width <br /> of said open''space shall be one-hundred (100) feet, measured from the mean high water level of <br /> the natural bank or fifty (50) feet back from the existing riparian habitat, whichever is greater. <br /> Water-dependent uses may be permitted in this buffer. The mean high water level and the edge <br /> of the riparian habitat shall be shown on the Parcel Map. The open space buffer required above <br /> shall be shovun on the Parcel Map with the following note: <br /> (1) Pursuant.':to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> h. ACCESS: The following access requirements apply and shall be shown on the Parcel Map: <br /> (1) A pfoposed 25-foot wide private easement for access to Parcels 1 through 3 and the <br /> Designated Remainder along the.Designated Remainder parcel shall be shown on the Parcel <br /> Map. (Dq elopment Title Section 9-1150.15) <br /> (2) The follgWing note shall be placed on the Parcel Map and also shall be recorded as a separate <br /> instrument: <br /> At the time of non-agricultural development of Parcels 1 through 3 and the Designated <br /> Rerrr'ainder, the entire length of the private right-of-way for the parcel shall be <br /> constructed and maintained to the standards required by the California Fire Code and <br /> apps o,able San Joaquin County Improvement Standards. (Development Title Section 9- <br /> 1150,.15[c]) <br /> i. ROAD NAMES: All subdivision road names shall be submitted to the Community Development <br /> Department for approval by the Director. Contact Kimberly Wallace at 468-0816 for road name <br /> standards. (Dwelopment Title Section 9-1150.18) <br /> Note-Podesta Lane will be extended along the proposed private right-of-way road. <br /> 2. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and <br /> employees fri3m any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to`.attack, set aside, void, or annul an approval of the local agency, advisory agency, <br /> appeal board; or legislative body concerning a subdivision, which action is brought within the time <br /> provided for in Section 66499.37 of the Government Code <br /> 3.
