CONDITIONS OF APPROVAL <br /> BULTHUIS TRIDILLON & MURPHY <br /> PA-1100114 <br /> Minor Subdivision Application No. PA-1100114 was approved by the Community <br /> Development Department August 25, 2011 . The effective date of approval is <br /> September 4, 2011. This tentative map approval will expire on September 3, 2011, <br /> which is three (3) years from the effective date of approval, unless (1) all Conditions <br /> of Approval have been complied with and (2) a Parcel Map has been filed with and <br /> accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements <br /> shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a <br /> Section Number have been identified as ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified and other ordinance <br /> requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Rick Griffin; [209]468-3154) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative <br /> map dated June 28, 2011. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following <br /> note shall be placed on the Parcel Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> c LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9- <br /> 610.4) <br /> (2) Parcel 1 shall be between two (2) gross acres and five (5) gross acres in size <br /> (Development Title Section 9-610.3[x]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice, stating that: <br /> (a) The homesite shall not be transferred until September 4; 2021, or upon <br /> the death of an owner owning at least fifty (50) percent interest in the <br /> homesite parcel, unless the homesite parcel and the remainder parcel <br /> are merged pursuant to the provisions of the Development Title. <br /> (b) The property shown on the Parcel Map is restricted from further <br /> subdivisions for homesite purposes, except for financing only, by <br /> Section 9--610.3 of the San Joaquin County Development Title. <br />
