The project site <br /> is located on the north side of Fremont Street, 200' east of Ellen Street, East Stockton. Our Permits <br /> Branch offer the following comment: <br /> - An encroachment permit will be required if drainage from the proposed project impacts the <br /> drainage ditch identified on the site plan. Please direct the applicant to include the <br /> affected portion of the State right of way in their environmental studies. This avoids the <br /> delay of a separate environmental review for the encroachment permit. You and the applicant <br /> should review the need for cultural resource, biological resource, and hazardous waste <br /> studies in our right of way. Review agencies and interest groups frequently challenge Caltrans <br /> permits on these issues. Please provide Caltrans with either (1) appropriate studies <br /> done by qualified professional staff, or (2) the rationale for your CEQA determination that <br /> those issues are not of concern in the State right of way.
