Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve Use Permit Application No. PA-03-565 with the Findings and Conditions of Approval <br /> contained in the Staff Report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the Stable-Commercial use type may be conditionally <br /> permitted in the AG-40 (General Agriculture-40 acre minimum) zone with an approved Use <br /> Permit. The project is consistent with the goals, policies, and standards of the General <br /> Plan and there are no Master Plans, Specific Plans, or Special Purpose Plans in the project <br /> vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the Department of Public Works is requiring the <br /> applicant to obtain an encroachment permit and improve the driveway(s) along Frewert <br /> Road in accordance with the requirements of San Joaquin County Standards R-17 prior to <br /> ^- issuance of the occupancy permit.- Standard Traffic Impact Mitigation Fees will be <br /> collected prior to issuance of a building permit. The applicant will also be required to <br /> obtain a Storm Water Pollution Prevention Plan (SWPPP) permit from the State Water <br /> Resources Control Board prior to the beginning of construction. The Environmental <br /> Health Department is requiring that the applicant provide adequate bathroom facilities <br /> prior to operation. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because 16.28-acres is of adequate size to accommodate the <br /> proposed number of horses (25)for boarding. The proposed project will comply with the <br /> requirement that states that, except for movement on and off the property, animals shall <br /> not be kept or maintained in pens, corrals, or within barns or similar structures, on <br /> property of less than 1/:acre, close than 40 feet from any rear or side property line <br /> (Development Title Section 9-1045.3 & Table 9-1045.3). The applicant's site plan <br /> demonstrates that the project will comply with parking, driveway, and access circulation <br /> requirements of the Development Title. The Environmental Health Department is requiring <br /> as a condition of approval, that the applicant submit a manure management plan to ensure <br /> that the number of animals per acre is consistent with appropriate waste management <br /> practices. <br /> San Joaquin County PA-03-565\Todeschini <br /> Community Development Page 4 <br />
