I located in the County of San Joaquin, California. <br /> 2 2. Petitioner Citizens Against Slaughter House is an unincorporated association <br /> 3 formed after the acts undertaken by respondents which form the subject matter of this action. <br /> 4 3. Respondents, County of San Joaquin, Board of Supervisors, is the agency <br /> 5 charged with the compliance with CEQA in relation to projects within the county and is the <br /> 6 agency acting in the present instance. <br /> 7 4. Real party in interest Richard Stango is an individual and is now, and at all <br /> 8 times mentioned in this petition was, a resident of San Joaquin County, California. This <br /> 9 proceeding directly affects the interest of real parry in interest in that this petition challenges <br /> 10 the issuance of a negative declaration and,following approval and issuance of a conditional <br /> 11 Use Permit which permits the commencement of and operation thereafter of a slaughter house <br /> 12 on property in which said real party in interest has a leasehold or other interest. <br /> 13 5. Real party in interest Hayre's Egg Farms, Inc. is a corporation which Petitioner <br /> 14 is informed and believes and thereon alleges, is a corporation duly organized and authorized <br /> 15 to do business in California, owns the land upon which the slaughter house is to be operated <br /> 16 and, petitioner is informed and believes, will be benefitted by the operation of the slaughter <br /> 17 house by real party in interest Stango. <br /> 18 6. Petitioners are beneficially interested in, and aggrieved by, the acts, decisions, <br /> 19 and omissions of respondents as alleged in this Petition. Petitioners have fundamental vested <br /> 20 rights and interests which are adversely affected by the acts, dr-cisions, and omissions of <br /> 21 respondents as alleged herein. <br /> 22 7. This action challenges the legality of the decision of respondents to approve a <br /> 23 Conditional Use Permit permitting the operation of a slaughter house on that certain real <br /> 24 property generally known as 690 West Frewert Road, Lathrop, being San Joaquin County <br /> 25 APN No. 191-260-16, owned by real parry in interest Hayre's Egg Farms, Inc. and to be <br /> 26 operated by real party in interest Stango, so that property might be used as a slaughter house <br /> 27 without complying with the California Environmental Quality Act (c) (Public Resources Cade <br /> 28 sections 21000 et seq.) and the attendant guidelines (California Code of Regulations, Title 14, <br /> 2 <br />
