Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> (1). Approve the mitigated Negative Declaration; and <br /> (2). Approve Use Permit PA-1200011 with the Findings and Conditions of Approval contained in <br /> the Staff Report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This Finding can be made because the addition of urban green waste to the existing <br /> composting facility may be conditionally permitted in the AG-40 zone with an approved Use <br /> Permit and is consistent with the A/G General Plan designation.There are no applicable <br /> Master Plans, Specific Plans, or Special Purpose Plans in the vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This Finding can be made because all utilities, improvements, and other facilities are existing <br /> or will be provided as reflected in the approved site plan. Projects in the AG-40 zone may use <br /> a private septic system, an individual well, and on site drainage. No new utilities are required. <br /> The project will meet the requirements of the Lathrop-Manteca Fire District. Access is from <br /> Frewert Road, which is a publicly maintained rural residential road. No improvements are <br /> required to Frewert Road. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This Finding can be made because the property is adequate in size to accommodate the <br /> provisions of the Development Title. The parcel is 31.4 acres in size. The proposed project will <br /> be the same twenty-acre size that was approved for the current use under PA-0500726. The <br /> parcel size permits the adequate movement of all necessary equipment, including fire <br /> suppression equipment. The parcel is surrounded by other agricultural uses. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This Finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts. The conditions of approval from the Community <br /> Development Department, the Department of Public Works, the Environmental Health <br /> Department, the Lathrop-Manteca Fire District, and the noise study conducted by j. c. brennan <br /> (14-foot tall noise barrier) will ensure that the environmental impacts will be less than <br /> significant.
