CONDITIONS OF APPROVAL <br /> PA-1300087 <br /> SORENSON/WONG ENGINEERS <br /> Minor Subdivision Application No. PA-1300087 was approved by the Community Development <br /> Department on September 11, 2013. The effective date of approval is September 21, 2013. This <br /> tentative map approval will expire on September 20, 2016,which is three (3)years from the effective <br /> date of approval, unless (1)all Conditions of Approval have been complied with and (2) a Certificate <br /> of Compliance has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Certificate of Compliance. Those Conditions followed by a Section Number <br /> have been identified as ordinance requirements pertinent to this application. Ordinance <br /> requirements cannot be modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Contact Staff: Stephanie Stowers[209]468-9653) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved tentative map dated June 3, 2013. A fee is required to process the <br /> Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be recorded as a Notice of Minor Subdivision Restriction with the Certificate of Compliance: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this Certificate of <br /> Compliance: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) <br /> d. PROPERTY LINE SETBACK:The following requirements shall apply: <br /> (1) The proposed new side and rear property lines for Parcels 1 and 2 shall meet the side yard <br /> setback requirements for the AG-40 zoning designation (General Agriculture, 40-acre minimum) <br /> for non-agricultural and agricultural structures. (Development Title Section 9-610.2) <br /> e. RIPARIAN HABITAT: Parallel to Littlejohns Creek, a natural open space area for riparian habitat <br /> and waterway protection shall be maintained to provide nesting and foraging habitat and the <br /> protection of waterway quality. The minimum width of said open space shall be one-hundred <br /> (100) feet, measured from the mean high water level of the natural bank or fifty (50) feet back <br /> from the existing riparian habitat, whichever is greater. Water-dependent uses may be permitted <br /> in this buffer. The open space buffer required above shall be recorded as a Notice of Minor <br /> Subdivision Restriction with the Certificate of Compliance with the following note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is designated <br /> as a natural open space for riparian habitat and waterway protection. No development other than <br /> water dependent uses shall be permitted in this space. <br />
