GARY AVENUE, STOCKTON) <br /> The applicant has submitted the above referenced Variance application to vary the thirty <br /> (30) foot street side yard setback in the R-VL (Very Low Residential) zone to a zero <br /> setback. The proposal if approved would allow the applicant to apply for a building <br /> permit for an existing attached carport. The property has a General Plan Designation of <br /> RNL (Very Low Density Residential) and is zoned R-VL (Very Low Density Residential). <br /> The project site is located on the north side of Gary Avenue, 190 feet west of Alhambra <br /> Avenue, northeast of Stockton. The surrounding land uses include single family <br /> residences and detached accessory buildings. <br /> The Community Development Department has reviewed the proposed Variance <br /> application and agency responses and offers the following comments: <br /> Background <br /> I <br /> i <br /> On September 9, 2006 the Enforcement Division of the Community Development <br /> Department opened an enforcement file (EN-0600692) because a carport was built <br /> without a proper permit and was built within the required setbacks of the R-VL zone. <br /> Currently, the posts of the carport exist at 0.77 feet from the subject property's street <br /> side yard property line and the roof overhangs three (3) feet into the fifty (50) foot public <br /> right-of-way of Gary Avenue. <br /> Existing Carport <br /> I The submitted Variance application is to vary the street side setbacks in the R-VL (Very <br />` Low Residential) zone from thirty (30) feet to a zero setback. This Variance application <br /> does not address the existing attached carport structure which currently extends into the <br /> public right-of-way.
