U
3. Use Authorized. The Variance will not authorize a use or activity which is not
otherwise expressly authorized by the regulation governing the parcel of
property.
The applicant states:
"Other properties in the area have similar structures that do not meet the 30 foot
setback. The existing side yard structures are 20 feet from the property line. The
right-of-way is already at the 50 foot maximum road width and will not be
widened. At a zero property line, access for fire and emergency vehicles will not
be impaired."
This finding can be made because the Variance does not change any
intended use permitted in the zone. A carport is a permitted accessory use
in the R-VL zone.
Planning Commission
This item is tentatively scheduled for the Planning Commission Hearing on February 7,
2008. The Community Development Department has reviewed Variance application No.
PA-0700236 and responses from other agencies, and will be recommending that the
project be denied based on the inability to make Findings Nos. 1 and 2.
KS:vb
PA-47002 36(V R)K S D C 01162008
Attachments
C: Karen Morris
3
