PA-0700236 OF KAREN MORRIS
(APN: 085-190-03)(ADDRESS: 9158 N. GARY AVENUE, STOCKTON)
M
w
The applicant has submitted the above referenced Variance pre-application to vary the
G thirty (30) foot street side yard setback in the R-VL (Very Low Residential) zone to a zero
setback. The proposal if approved would permit the construction of an existing attached
carport. The property has a General Plan Designation of RIVL (Very Low Density
Residential) and is zoned R-VL (Very Low Density Residential).
The project site is located on the north side of Gary Avenue, 190 feet west of Alhambra
Avenue, northeast of Stockton. The surrounding land uses include single family
residences and detached accessory buildings.
The Community Development Department has reviewed the proposed Variance pre-
application and agency responses and offers the following comments:
Background
On September 9, 2006 the Enforcement Division of the Community Development
Department opened an enforcement file (EN-0600692) because a carport was built
without a proper permit and was built within the required setbacks of the R-VL zone.
Currently, the posts of the carport exist at 0.77 feet from the subject property's street
side yard property line and the roof overhangs three (3) feet into the fifty (50) foot public
right-of-way of Gary Avenue.
Agency Responses
The Community Development Department has received two responses from the
following agencies; the San Joaquin County Sheriff Department and the City of Stockton
Public Works Department. Specifically, the Sheriff Department stated that they would
not be able to support the project because the encroaching structure would cause
clearance issues. The City of Stockton Public Works Department stated that they also
F cannot support the proposed project because the reduction lends to the potential of
i
i 1
