3.0 SITE INSPECTION OBSERVATIONS <br /> 3.1 SITE LOCATION <br /> Patterson Pass Business Park Building #5 is located at 25521-25653 S. Gateway Boulevard in <br /> Tracy, San Joaquin County, California. The legal description for the subject property is Part of <br /> Lots 2 and 6, Patterson Pass Business Park, Tract No. 2450. The subject property is located in <br /> Township 2 South, Range 4 East, Section 34. Figure 1 shows the location of the subject <br /> property. <br /> Some states have enacted so-called "superlien" provisions that allow a state environmental <br /> agency to recover environmental cleanup costs through a first-priority lien against the property <br /> of the person responsible for the contamination problem. According to the Due Diligence Guide <br /> (Section 101.5(a), Bureau of National Affairs, Inc., Washington, DC), California is not among the <br /> states with such superlien provisions. <br /> Some states have also enacted legislation that imposes requirements for environmental <br /> remediation in some circumstances as a pre-condition to concluding certain common forms of <br /> business transactions involving the transfer of real property. According to the Due Diligence <br /> Guide (Section 101.5(b), Bureau of National Affairs, Inc., Washington, DC), California is not <br /> among the states with such property transfer requirements. <br /> 3.2 SITE DESCRIPTION <br /> The subject property consists of a 3.89-acre parcel of land that is improved with a single-story <br /> warehouse/production/distribution building totaling 84,000 square feet. The remainder of the <br /> subject property consisted of three concrete truck aprons surrounding the buildings, with <br /> asphalt-paved parking and driveway areas and landscaped vegetation around the perimeter and <br /> near office entrances.
