3
B.2. "Intent" of County Code to "Wineries and Related Facilities"
The County's land use policy for wineries and wine-related"marketing events" is
stated clearly in the Code's"Intent" section on Wineries regulation, essentially that:
1) "A major purpose" of the Code "is to guarantee that" winery "marketing
events are accessory and are subordinate to the primary agricultural use"; and
that
2) The Code's regulations are designed to help the wine industry thrive "while
simultaneously discouraging or inhibiting on-going uses that would degrade or
that would be incompatible with the ambiance of an agricultural area and the
production of wine." (SJC Code § 9-1075.1.)
C. Applicants' Behavior Has Already Blatantly Violated the Code and Their 2005
Permit
C. 1. The St. Jorge Winery Has Operated as a"Full Service Event
Destination"
As explained in some detail below (and more extensively in the Isolas' Comment
Letter), the St. Jorge Winery business received a permit from the San Joaquin County
Community Development Department in 2005. Since then the St. Jorge Winery has been
conducting its operations well beyond the terms not only of that permit, but beyond the
laws of the San Joaquin County Code as well.
These illegal business operations already conducted include:
• Advertising the Winery as"a full service event destination" see"Attachment A"),which
offers
• "All the necessary attention to detail for weddings, banquets, or small
gathering,"with
• The serving of food at large events, by
• "Using our state of the art (uninspected, unlicensed and unapproved]
commercial kitchen,"including
• The use of amplified music, although prohibited by permit, while
• Holding more than its permitted four events a year, with
• More than its permitted 25 people per event, none of which is allowed in
the Winery's current 2005 San Joaquin County permit.
incompatible with the ambiance of an agricultural area and the production of wine." (San Joaquin
County Code,Title 9"Development Title of San Joaquin County';Division 10,"Development Regulations';
Chapter 9-1075,"Wineries and Related Facilities," Section 9-1075.1,"Intent."
