CONDITIONS OF APPROVAL <br />PA -1800160 <br />MHI LLC/TURLOCK PETROLEUM <br />Minor Subdivision Application No. PA -1800160 was approved by the Board of Supervisors on April <br />9, 2019 pursuant to Board Resolution No. R-19-51. The effective date of approval is April 9, 2019. <br />This tentative map approval was originally scheduled to expire on April 18, 2022, which is three <br />years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br />with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. The applicant <br />has timely filed for a time extension on or before April 18, 2022. The Community Development <br />Department (CDD) has reviewed the request and has determined a one-year time extension is <br />approved. Pursuant to Chapter 9-881.3, the CDD as the review authority, has the ability to approve <br />the requested time extension. The new expiration date for minor Subdivision Application No. <br />1800160 is therefore April 18, 2023. <br />Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br />prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br />identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br />be modified, and other Ordinance requirements may apply. <br />1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: John B. Anderson, 209-468-3160) <br />a. TENTATIVE MAP: The Parcel Map shall substantially conform with the revised tentative map dated <br />December 7, 2018. <br />b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br />shall be placed on the Parcel Map and recorded as a separate instrument: <br />(1) All persons purchasing lots within the boundaries of this approved map should be prepared to <br />accept the inconveniences or discomforts associated with agricultural operations or activities, <br />such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br />inconveniencies or discomforts shall not be considered to be a nuisance. <br />c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br />(1) Parcel 1 shall have a minimum lot area of three (3) net acres in size. <br />(2) Parcels 2 & 3 shall have a minimum lot width 100 feet, measured at the front yard setback line. <br />(Development Title Section 9-510.4M) <br />(3) Parcels 2 & 3 shall have a minimum lot area of 10,000 square feet. COUNTY COUNSEL <br />HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider <br />shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from <br />any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, <br />set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative <br />body concerning a subdivision, which action is brought within the time provided for in Section 66499.37 of <br />the Government Code. <br />3.
