4.3 GENERAL PLAN POLICIES AND ZONING
<br /> This section analyzes the project's compliance with the San Joaquin County General Plan 2010(San Joaquin
<br /> County Community Development Department[SJCCDD] 1992),the Mountain House New Community Master
<br /> Plan(as amended 2004), and the San Joaquin County Development Title(Development Title).The MHMP is the
<br /> ` implementing document for the County General Plan for the Mountain House community, and as such,must be
<br /> consistent with the County's General Plan.For this reason,the focus of the policy consistency analysis is on
<br /> compliance with policies found in the MHMP.
<br /> The San Joaquin—Delta Community College District(SJDCCD)is constitutionally exempt from local land use
<br /> regulations when using SJDCCD property in furtherance of the SJDCCD's educational purposes.However,the
<br /> SJDCCD has agreed to process a MHMP amendment for the proposed project as part of the College Park project.
<br /> 4.3.1 EXISTING PLANNING DOCUMENTS
<br /> SAN JOAQUIN COUNTY GENERAL PLAN 2010 AND DEVELOPMENT TITLE
<br /> r San Joaquin County adopted an updated General Plan and Development Title in July 1992.The General Plan
<br /> addresses goals,objectives,and policies regarding existing and future development within the County, including
<br /> policies for new communities.The Development Title includes County Zoning Regulations, Subdivision
<br /> Regulations,Development Regulations, Infrastructure Standards,Financing for Infrastructure and Services,
<br /> Development Agreements,Natural Resource Regulations, Safety Regulations,Williamson Act Regulations, and
<br /> Enforcement Regulations meant to implement the General Plan,
<br /> The San Joaquin County Board of Supervisors amended the General Plan 2010 in February 1993 to include the
<br /> new community of Mountain House.At that time,the Board designated generalized urban land uses for all of
<br /> Mountain House,including the project site.The urban land uses for Mountain House include five General Plan
<br /> categories of Residential use(Very Low-Density,Low-Density,Medium-Density,Medium-High Density, and
<br /> High-Density),six commercial categories(Neighborhood,Community,General, Freeway Service,Office,and
<br /> Mixed Use),two Industrial categories(Limited and General),and various Public,Parks, Resource Conservation
<br /> .. and Open Space categories.
<br /> The Mountain House Master Plan(MHMP)was adopted in 1994 and the land use designations of the MHMP
<br /> match those of the County's General Plan.The General Plan was later amended to designate the MHMP Land
<br /> Use Map as the General Plan Land Use Map for the Mountain House community.The MHMP residential
<br /> designations for the project site are Very Low-Density,Low-Density,Medium-Density,and Medium-High
<br /> Density. Commercial and industrial designations include Freeway Service Commercial,Office Commercial,
<br /> Limited Industrial,and Neighborhood Commercial.Parkland designations are also located within the College
<br /> Park site.
<br /> The area designated for the Neighborhood Commercial Centers in the MHMP is a"floating"designation and can
<br /> be moved anywhere within the general area of Neighborhoods A,B,and D.The College Park site only includes a
<br /> portion of Neighborhood D, and the Neighborhood Commercial site has been included within that portion of
<br /> Neighborhood D that is located within Specific Plan II(SJCCDD,2004).
<br /> The site is currently zoned AU-20,which is Agriculture Urban Reserve with a 20-acre minimum parcel size.
<br /> Rezonings to urban uses within Mountain House occur upon adoption of a Specific Plan that contains the zoning
<br /> map for the Specific Plan area.For the SJDCCD site,the SJDCCD is exempt from local land use controls and
<br /> thus could develop the college portion of the project without rezoning approval.However, SJDCCD is voluntarily
<br /> complying with the MHMP and College Park at Mountain House Specific Plan III(hereinafter referred to as the
<br /> College Park Specific Plan III)to facilitate an orderly planning process and qualify for services from the
<br /> MHCSD.
