• Superfimd Amendments and Reauthorization Act Title III — <br /> • Resource Conservation and Recovery Act(RCRA) <br /> • Safe Drinking Water Act <br /> • Tonic Substances Control Act <br /> At the federal level,the principal agency regulating the generation, transport, and disposal of hazardous <br /> materials is the EPA,under the authority of RCRA.The EPA regulates hazardous materials sites under _ <br /> CERCLA. Applicable federal regulations are contained primarily in Titles 29,40,and 49 of the CFR. <br /> STATE REGULATIONS <br /> Hazardous Materials Management, Substances Handling, and Worker Safety <br /> The California Environmental Protection Agency(Cal-EPA)and the Office of Emergency Services <br /> (OES)establish rules governing the use of hazardous materials. S WRCB has primary responsibility to <br /> protect water quality and supply. The following represents the primary state laws governing hazardous <br /> materials: — <br /> • Hazardous Substances Control Law <br /> • Hazardous Substances Release Response Plans and Inventory Act _ <br /> Hazardous Substances Information and Training Act <br /> • Underground Storage of Hazardous Substances Act <br /> • Air Toxics Hot Spots and Emissions Inventory Law <br /> • Public Safety/Fire Regulations/Building Codes <br /> Porter Cologne Water Quality Act <br /> In Cal-EPA,the California Department of Toxic Substances Control(DTSC)has primary responsibility, <br /> with delegation of enforcement to local jurisdictions, for the generation,transport, and disposal of <br /> hazardous substances under the authority of the Hazardous Waste Control Law(HWCL). State <br /> regulations applicable to hazardous substances are outlined in Title 26 of the California Code of — <br /> Regulations(CCR). <br /> Regulations implementing the HWCL list hazardous chemicals and common substances that may be _ <br /> hazardous; establish criteria for identifying,packaging and labeling hazardous substances;prescribe <br /> management of hazardous substances;establish permit requirements for hazardous substances treatment, <br /> storage,disposal,and transportation; and identify hazardous substances that cannot be deposited in landfills. _. <br /> The California Occupational Safety and Health Administration(Cal-OSHA)assumes primary <br /> responsibility for developing and enforcing workplace safety regulations in the state.Cal-OSHA <br /> regulations concerning the use of hazardous substances include requirements for safety training, <br /> availability of safety equipment,hazardous substances exposure warnings, and emergency action and fire <br /> prevention plan preparation. Cal-OSHA enforces the hazard communication program regulations, which <br /> include provisions for identifying and labeling hazardous substances,describing the hazards of chemicals, <br /> and documenting employee training programs. <br /> School Siting — <br /> The CCR,Title 5-Education, Section 14010, Standards for School Site Selection,requires that a risk <br /> assessment study be prepared where a proposed school would be located in 1,500 feet of an existing natural _ <br /> gas transmission pipeline,water storage tank,or canal.The intent of this requirement is to document the <br /> potential explosion or inundation hazards to kindergarten through 12th grade(K-12)schools posed by the <br /> EDAW College Park at Mountain House Specific Plan III Draft ERR <br /> Public Health and Safety 4.9-14 San Joaquin County <br />
