• Mitigation Measure M4.114 <br /> (a) To provide for protection of any populations of special-status species along the Old River frontage of the <br /> site,the following should be included as part of the Parks and Open Space Master Plan as an additional <br /> Implementation for Objective 4 of Biological Resources Management section(Appendix C): <br /> "j) A habitat protection plan shall be prepared for the population of Mason's lilaeopsis in the <br /> northwestern portion of the site prior to approval of the fust specific plan adjacent to Old River in <br /> this area. The habitat protection plan shall be prepared by a qualified plant ecologist in — <br /> consultation with and which meets with the approval of representatives of the USFWS and DFG. <br /> The plan shall provide for the protection of identified populations,addressing potential impacts <br /> associated with boating,marina development, water diversion,storm drainage runoff,levee — <br /> modifications, and recreational use of levee habitat. <br /> "k) A habitat protection plan for Mason's lilaeopsis and other special-status taxa which may be _ <br /> encountered during further detailed surveys, shall be prepared prior to approval of any specific <br /> plan along Old River. Other special-status taxa of concern include delta smelt, Sacramento <br /> splittail,winter-nun chinook salmon,and California hibiscus. _ <br /> "1) A survey shall be conducted along the banks of Old River to confirm the presence or absence of <br /> the California hibiscus on the site,prior to approval of any specific plan which could affect Old <br /> River. The survey shall preferably be conducted by a qualified botanist during the blooming <br /> period of this species, in August and September. If populations of this species are encountered,a <br /> habitat protection plan shall be prepared by a qualified plant ecologist in consultation with <br /> representatives of the USFWS and DFG. The plan shall provide for the protection of identified — <br /> populations,addressing potential impacts associated with boating,marina development, water <br /> diversion, storm drainage runoff, levee modifications,and recreational use of levee habitat. <br /> "m)A survey shall be conducted to confirm the presence or absence of delta smelt, winter-run <br /> chinook salmon, and Sacramento splittail along the river segment bordering the site,prior to <br /> approval of any specific plan which could affect Old River. The survey shall be conducted by a _ <br /> qualified fishery biologist using an otter trawl at intervals along the river segment during the <br /> spring spawning season and during migration periods. If any of the species is detected, a habitat <br /> protection plan should be prepared by a qualified fisheries biologist in consultation with and _ <br /> which meets with the approval of representatives of the USFWS and DFG. The plan shall <br /> provide for the protection and enhancement of existing habitat conditions,addressing potential <br /> impacts associated with boating, marina development,water diversion, storm drainage runoff, <br /> levee modifications,and recreational use of levee habitat." — <br /> (b) Several aspects of the Draft Master Plan provisions regarding Other Special-Status Species should be <br /> revised to ensure protection of active nests and compliance with applicable state and federal regulations, <br /> as follows: <br /> • Revise Implementation(b)for Objective 4 of Biological Resources Management(Appendix C)to _ <br /> include pre-construction raptor surveys along the Old River frontage of the site as well. <br /> • Revise Implementation(c)for Objective 4 of Biological Resources Management to indicate that any _ <br /> relocation of an active burrowing owl nest should be performed in accordance with DFG guidelines <br /> and that a permit must be obtained prior to any disturbance to the nest. <br /> • Revise Implementation(i)for Objective 4 of Biological Resources Management to indicate that pre- <br /> construction raptor and burrowing owl surveys would still be required to protect active nests until <br /> young birds have fledged even if an applicant participates in the FIMP or other conservation plan. <br /> EDAW College Park at Mountain House Specific Plan III Draft EIR <br /> Biological Resources 4.10-22 San Joaquin County <br />
