Special Purpose flan Cassano K.ainilos Homes at College Park. <br /> College <br /> SECTION FOUR: LOTS, PARCELS AND EASEMENTS <br /> 4.1 Introduction <br /> Lots and parcels within the project area shall be created to allow fee simple <br /> ownership of residential units and to ensure continued neighborhood quality <br /> through community ownership of common areas. Lots refer to parcels of land on <br /> which a residential structure may be built. Parcels refer to those private streets <br /> and open areas to be owned in common by all lot owners via a Home Owners <br /> Association (HOA) or similar entity. (See Figure 4.1, Typical Lots) <br /> 4.2 Lots <br /> Residential lots shall typically include only the residential dwelling unit and a <br /> small area outside the footprint of the building: <br /> 1. Each primary residential unit shall occupy its own lot. <br /> 2. Residential lots shall encompass the entire habitable structure, including any <br /> appurtenant second unit. Non-habitable elements such as covered porches, <br /> balconies,bay windows, eaves,media niches, chimneys or other projections <br /> from the main building, patios or courtyards may be outside the lot, so long <br /> as the private use of these areas is provided for with an easement on the <br /> relevant lot or parcel. <br /> 3. Lots may be encumbered by easements to provide for a variety of uses (see <br /> Section 4.4, below.) <br /> 4.3 Parcels <br /> Parcels shall be those areas within the project not occupied by residential lots. <br /> Parcels shall typically include such things as project entries, circulation streets, <br /> shared driveways, pedestrian pascos, Linear Park, etc. <br /> I. Parcels maybe conveyed to a Home Owners' Association or similar entity, or <br /> held by the project applicant or applicant's designee in order to assure proper <br /> project implementation and maintenance. <br /> 2. Parcels may be encumbered by easements to provide for a variety of uses (see <br /> Section 4.4, below.) <br /> 4.4 Easements <br /> The Cassano Kamilos Homes at College Park project shall include a variety of <br /> easements,providing for such things as public and/or private utilities, landscaping <br /> maintenance, access by residents and others, emergency vehicle access, and <br /> private outdoor areas, as illustrated in Figure 4.2, Easements Relating to Private <br /> Lots, and in Figure 4.3, Easements Relating to HOA Parcels.
