<br /> C. The Wastewater Treatment Plant expansion requirement in Condition 26.A shall meet

<br /> required for long-term discharge into Old River..Additional treatments thatmay be
<br /> required by the RWQCB for such pollutants-as dissolved solids, metals and heat,
<br /> I etc.,shall be addressed in the plant expansion: The developer shall bond 'for or fund
<br /> construction for the-developer's fair share cost prior to the filing of the first Final Map.
<br /> 28. Water Treatment Plant: Under-the direction of the MHCSD, the applicant shall fund, design
<br /> and construct the last phased expansion of the water treatment plant(WTP)'to provide the
<br /> capacity required to serve Tract No.3601 prior to issuance of the first building permit.
<br /> Recognizing that there may be agreements between the developers for sharing capacity and
<br /> also recognizing that the MHCSD is not a party to and has no control over such agreements,
<br /> bonding for construction shall be provided prior to approval of the first final map and
<br /> beginning of construction shall be at the discretion of the General Manager. Issuance of
<br /> building permits shall cease if construction does not begin when directed by the General
<br /> Manager.
<br /> 29. Other Water System Facilities: Water storage requirements, booster pump station and
<br /> looping of the water distribution system pipelines shall be done in accordance with the Water
<br /> Master Plan and as directed by the MHCSD prior to issuance of the first building permit in
<br /> l SP Ill. Construction of one tank may be allowed if an engineering analysis shows that the
<br /> second tank may be constructed at a later date without adverse impact on the first tank
<br /> and/or existing customers of MHCSD. Each phase of SPIII will be reviewed to confirm the
<br /> existing "in-place" infrastructure is adequate to provide MHCSD Design Standards.
<br /> 30. BBID Canal: The applicant shall reroute the canals as directed by BBID in order to ensure
<br /> continued supply of agricultural irrigation water to lands remaining in agricultural use
<br /> following construction. Timing: Approval of the rerouting and grading and improvement
<br /> plans approved by MHCSD prior to approval of first Final Map.
<br /> 31. Hold Harmless Provision: The subdivider shall defend, indemnify, and hold harmless the
<br /> MHCSD, its agents, officers, and employees, from any claim, action, or proceeding against
<br /> the MHCSD, its agents, officers, or employees, to attack, set aside, void, or annul an
<br /> approval of MHCSD concerning any MHCSD condition, which action is brought within the
<br /> time provided for in Section 66499.37 of the Government Code.
<br /> 32. Landscaping and Architecture:
<br /> A. The Al! in-tract landscaping and utility R/W areas and all other landscape areas
<br /> including Parks"A","B"and all open space areas that were not in the original Master
<br /> Plan, the MHCSD Parks, Recreation and Leisure Plan, the TIF or the CFF (January,
<br /> 2003)as determined by MHCSD, will require a funding mechanism such as HOA or
<br /> Landscape and Lighting Maintenance District as determined by MHCSD. These areas
<br /> will require establishment of a maintenance entity or financing mechanism acceptable to
<br /> MHCSD to provide funding for maintenance of, and if necessary, replacement at the end
<br /> of the useful life of improvements including, but not limited to landscaping, pathways,
<br /> walls, and all improvements serving or for the special benefit of this subdivision. The
<br /> financing mechanism shall be completed and adopted by the Board of Directors prior to
<br /> the approval of the first Final Map.

<br /> B. The Applicant shall comply with the landscaping and architectural theme to be used
<br /> within the entire Neighborhood 'A/B'. Design shall be consistent with all Community
<br /> Approvals including applicable provisions of the MHCSD.Design.Manual and any
<br /> applicable Special Purpose Plan: Timing prior to approval cf first Final Ma`p.
<br /> C. The.applicant shall.submit.a complete''setof Landscape Guidelines.lrhprovement Plans
<br /> 'for.Tract 3601:' Landscaping and architectural design of public and open space areas
<br /> shall implement the corhmon-design theme for:the'entire Neighborhood 'AIB' and shall
<br /> be consistent with all Cammunity Appro�ais including applicable provisions of the
<br /> MHCSD Design Manual and any applicable Special Purpose Pian. Timing: prior to first
<br /> Final Map.
<br /> D. Site furniture, consistent-with the common design theme of Neighborhood 'AIB', shall be
<br /> incorporated into the Improvement Plans and shall be consistent with the MHCSD
<br /> Design Manual. The site furniture, including "Bus Stop Shelters", shall'be a part of the
<br /> design plans and shall comply witli'all Community Approvals including applicable
<br /> provisions of the MHCSD Design Manual. Timing: plans shall be reviewed and
<br /> approved by MHCSD prior to the approval of the first building permit.
<br /> E. Roadway, streetscape, and landscaping shall be designed consistent with all
<br /> Community Approvals including applicable provisions of the MHCSD Design Manual
<br /> and Standards. Timing: the design plans associated with each phase of the
<br /> development shall be completed and approved by the MHCSD General Manager prior to
<br /> the approval of the Final Map for that phase.
<br /> F. The Roadway Landscape Construction Plans shall be processed and approved by the
<br /> MHCSD General Manager concurrently with the Improvement Plans for any phase
<br /> within the Tract 3601 development.
<br /> G. Neighborhood Entries Construction and Landscaping for Tract 3601 shall be designed
<br /> consistent with the common design theme for the entire Neighborhood 'AIB' and with all
<br /> Community Approvals including applicable provisions of the MHCSD Design Manual,
<br /> and shall be reviewed and approved by the MHCSD General Manager concurrently with
<br /> the adjacent Street improvement Plans. Timing: Improvement Plans for entries shall be
<br /> approved by MHCSD prior to the approval of the project's Final Map.
<br /> H. The Applicant shall amend as necessary all plantings and irrigation for landscape within
<br /> College Park Avenue to provide for Tract 3601 Front Entry Walkway Connections to the
<br /> Public Street Sidewalk. All work and/or modifications shall be reviewed and approved
<br /> by the MHCSD General Manager. Timing: Condition shall be met prior to first building
<br /> permit. Completion time may be modified by the MHCSD General
<br /> Manager to reflect
<br /> construction,on, weather, budget, or other
<br /> g public interest contingencies.
<br /> L Landscaping and architectural design of all parcels, designated as HOA or Landscape
<br /> Maintenance District, shall be consistent with all Community Approvals including
<br /> applicable provisions of the MHCSD Design Manual and MHCSD Standards. The
<br /> design plans associated with each phase of the development shall be completed and
<br /> approved by the MHCSD General Manager prior to the approval of the Final Map for
<br /> that phase.
<br /> J. Landscaping installed shall comply with MHCSD Standard Plans for intersection sight
<br /> distance, Corner Sight Distance, Sight distance off-sets to traffic control devices, street
<br /> lights, and clearance above streets (15'), and sidewalk/trails (8').
<br /> K. Community Walls, consistent with the MHCSD Design Manua! and MHCSD Standards
<br /> shall be installed at the property line between residential properties and all public or
<br /> private parcels. View Fencing or no fencing may be permitted in locations where

<br /> residences face the Open Space as deemed appropriate by the MHCSD. Plans to be
<br /> consistent with all Community Approvals including applicable provisions of the MHCSD
<br /> Design Manual,'MHCSD Standards; and any-applicable Special Purpose Plan.

<br /> L. Landscaping of Neighborhood Entries and Arterlal.lnl:Mections.shall be installed,
<br /> concurrently:wi#h the landscaping of adjacent streets. Entries and Arterial Intersections
<br /> . shall be.designed°and constructed consistent with all Community Approvals including
<br /> applicable provisionsof the--MHCSD Design Manual, 'and'shall be reviewed and
<br /> approved by the MHCSD General Manager concurrently with the adjacent street
<br /> Improvement.Platin. 'Timing: Improvement Plans for entries and intersections shall be
<br /> approved by MHCSD prior to the approval of the project's Final Map.
<br /> 33. A1B Neicihborhobd Parks:
<br /> A. The neighborhood parks,identified within Specific Plan !!l shall be dedicated to MHCSD
<br /> or an offer of dedication to the MHCSD shall be recorded with the first Final Map.
<br /> Timing: conditionshall be met with approval of first Final Map of Neighborhood AIB.
<br /> B. The entire AIB Neighborhood Park shall be designed consistent with all Community
<br /> Approvals including applicable provisions of the Parks, Recreation and Leisure Plan and
<br /> the MHCSD Design Manual. The design of the park shall be reviewed and approved by
<br /> MHCSD. Timing: condition shall be met prior to approval of first Final Map.
<br /> i C. The MHCSD General Manager may allow the Neighborhood Park to be constructed in
<br /> phases to be consistent with usage demand and other public interest considerations.
<br /> Final design of the first phase of the Neighborhood Park shall be completed before its
<br /> construction. Construction of the first phase of the neighborhood park shall begin no
<br /> later than the time at which 50% of the dwelling units for Neighborhood AIB (separate
<br /> from Neighborhood D)or school attendance area, whichever is sooner, have been
<br /> issued a building permit. The Park shall be completed no later than the time at which
<br /> 80% of dwelling units for the neighborhood have been issued building permits.
<br /> Completion time may be modified by the MHCSD General Manager to reflect
<br /> construction, weather, budget, or other public interest contingencies.
<br /> D. A formal agreement for joint use of parks and recreation facilities with adjacent K-8
<br /> schools shall be required prior to construction of the park. (Implementation Measure
<br /> 7.2.2.3d)
<br /> 34. South Community Park:
<br /> A. Community Park land identified within Specific Plan Ill shall be dedicated to MHCSD on
<br /> a minimum of a pro rata basis, as determined by MHCSD, with the applicant to pay fair
<br /> share of all park improvements. Timing: prior to approval of First Final Map.
<br /> B. The entire South Community Park shall be designed to a 30% design completion level
<br /> consistent with all Community Approvals including applicable provisions of the Parks,
<br /> Recreation and Leisure Plan and the MHCSD Design Manual. The design of the park
<br /> shall be reviewed by both the DCRC and MHCSD and approved by the MHCSD.
<br /> Timing: condition shall be met prior to issuance of the first building permit within Tract
<br /> 3601.
<br /> C. The MHCSD General Manager may allow the South Community Park to be constructed
<br /> in phases to be consistent with usage demand and other public interest considerations.
<br /> Final design of the first phase of the South Community Park shall be completed before
<br /> its construction. Construction of the first phase of South Community Park shall begin no
<br /> later than the time at which 50% of the dwelling units permits for Specific Plan Ill have
