EXHIBIT A <br /> Bases for Specific Plan III Amendment (PA-0600365) <br /> 1. The proposed Specific Plan III amendments are consistent with the General Plan, the <br /> Master Plan, and the Public Financing Plan. <br /> This determination can be made because the proposed map and text changes,in <br /> association with Community Development Department Conditions of Approval#37 <br /> (regarding the submittal of a Wetland Mitigation/Replacement Plan)and#38 <br /> (regarding the preparation of a Riparian Habitat Mitigation Plan)for Major <br /> Subdivision Application PA-0600363, are consistent with the policies of the General <br /> Plan and the Master Plan regarding the replacement of riparian habitats and <br /> wetlands that will be destroyed as a result of development,and because the <br /> proposed changes do not negatively affect the Public Financing Plan. Because the <br /> wetland on the project site is the only wetland shown on the Specific Plan land use <br /> map,its elimination necessitates that wetland replacement occur( if feasible) in the <br /> Mountain House Creek Corridor(rather than within the Specific Plan III area <br /> adjacent to other preserved wetlands). <br /> 2. The Specific Plan or Specific Plan Amendment will not adversely affect the jobsthousing <br /> program and housing affordability. <br /> This determination can be made because the Specific Plan III amendments, <br /> although permitting the development of an additional five primary dwelling units on <br /> the project site, would not increase the total number of housing units permissible as <br /> a result of wastewater limitations in the Specific Plan III area. Approval of Major <br /> Subdivision Application; PA-0600363 would result in the development of 53 single- <br /> family, Low Density Residential (R-L) units,whereas the number specified by Specific <br /> Plan III for the project site is 48. Under Specific Plan III(Implementation Measure <br /> 3.2.5.4(a)),this 5 unit increase is allowed. Golden State Investments LP has not <br /> utilized 8 Medium-High Density Residential (R-MH) units in the recently approved <br /> Regents Gate subdivision to which it was otherwise entitled by Specific Plan Ill. The <br /> wastewater that would have been generated by these R-MH units is equivalent to that <br /> generated by 5 R-L units. As required by Specific Plan III,Golden State Investments <br /> LP has assigned this residential-based wastewater allocation to the project applicant, <br /> Golden State Investments II LP,who is a different owner,via an Assignment <br /> Agreement. <br /> 3. All applicable provisions of the Mountain House Development Agreement have been met. <br /> This determination can be made because the proposed Development Agreement <br /> incorporates provisions of the existing, principal Mountain House Development <br /> Agreement (Amended and Restated Master Plan Development Agreement by and <br /> between County of San Joaquin and Trimark Communities Relative to the <br /> Development of Certain Property within the Mountain House Community) and <br /> modifies and supplements those provisions only as necessary. Additionally, this <br /> determination can be made because the proposed Development Agreement vests <br /> certain provisions/sections of the General Plan, Master Plan,the Mountain House <br /> Development Title, and Specific Plan III,that have previously been found to be <br /> consistent with said documents (e.g., the Public Land Equity Program Ordinance). <br /> 1 <br />
