Approval #38 for,Major.Subdivisio,n Application P"600363....6Riparian habitat
generally`does not include wetlands{see Section 9 1'10.4 of the San Joaquin
County Development Title),however, to the extent that the elimination of,any
wetlands habitat;on the site is ggmpensa#ed by the Ripar:an Habitat gation
Plan, the compensatrop.provided lay the Riparian Habitat Matigation #Mari`would
serve.as i-titigatian for,.the, loss`of the:wetlands.'
2 The Master Pian Amendment will not adversely affiect the lobslho" ""'program and
housing`affordability. M E,
r
This determination can be made because the MasterPlan amendment;although
permitting the development of an additional fiveprimary dwelling units ori.the project
site, would.not increase the total number of housing units permissible as,a result of
wastewater limitations in the Specific Plan Ill area. Approval of Mayor Subdivision
Applic6fion`PA-0604363 would result in the development of 53 single family,Low
Density Residential(R L) units,whereasthe number specified.bySpecific,Plan Ili for
'the project site is 48. Under Specific Plan III(Impleirrentation Measure 3.2 5:4(a)),this
5 unit increase is allowed, Golden State Investments LP has not u#ilized 8,Medium-
High Density Residential (R-MH) units in the recently approved Regents Gate
subdivision to which it was otherwise.entitled by Specific Plan Ill. The wastewater
that would have been generated bylhe6e R-MH units is equivalent to that generated
by 5 R-L units. As required by Specific Plan 111, Golden State Investriients.LP has
assigned this residential-based wastewater allocation to theproject applicant, Golden
State Investments 11 LP,who is a different owner, via an Assignment Agreement.
3. All applicable provisions of the Mountain House Development Agreement will be met.
This determination can be made because the proposed Development Agreement
incorporates provisions of the existing, principal Mountain House Development
Agreement(Amended and Restated Master Plan Development Agreement by and
between County of San Joaquin and Trimark Communities Relative to the
Development of Certain Property within the Mountain House Community) and
modifies and supplements those provisions only as necessary. Additionally, this
determination can be made because the proposed Development Agreement vests
certain provision stsections of the General Plan, Master Plan, the Mountain House
Development Title, and Specific Plan Ill,that have previously been found to be
consistent with said documents(e.g.,the Public Land Equity Program Ordinance).
4
