ENVIRONMENTAL CHECKLIST <br /> 4.9 LAND USE AND PLANNING <br /> Mitigation Measures <br /> No mitigation measures are required. <br /> b) Conflict with any applicable land use plan,policy, or regulation of an agency.with-3 <br /> jurisdiction over the project (including, but not limited to the general plan, speciflc <br /> plan, local coastal program, or zoning ordinance) adopted for the purpose of avoiding <br /> i <br /> or mitigating an environmental'effect?. <br /> The applicant is proposing:a total of 63 single-family dwelling units and sik s'e'condary unit's <br /> on 12,72 acres. This is consistent with the SPIII General Plan and Zoning density for the <br /> property. The applicant is proposing to remove the riparian corridor,which is inconsistent <br /> with the General Plan and Zoning Land Use Maps and will require an amendment to these <br /> documents. <br /> The development plan is consistent with policies in Specific Plan III to create pedestrian <br /> walkways, as well as a mix of housing types to meet affordable housing goals. The proposed <br /> project and densities are within the scope of the SPIIIEIR and does not create any new <br /> impacts. <br /> Mitigation Measures <br /> 1 No mitigation measures are required. <br /> c) Conflict with any applicable habitat conservation plan or natural community <br /> conservation plan? <br /> The proposed project would not conflict with any adopted Habitat Conservation Plan,Natural <br /> Community Conservation Plan, or other approved conservation plan. The San Joaquin <br /> County Multi-Species Habitat Conservation and Open Space Plan(SJMSCP) has been <br /> prepared to provide a strategy for balancing the need to conserve agricultural lands and <br /> wildlife habitat while accommodating a growing population in the County. The SJMSCP is <br /> designed to establish an assessment process for conversion of land to non-open space uses <br /> when such conversion may affect the plant, fish, and wildlife species covered by the <br /> ° SJMSCP. <br /> Compliance with the SJMSCP will be met through the applicant's payment of the SJMSCP <br /> fee along with pre-construction surveys and "take" avoidance measures spelled out in the <br /> j SJMSCP. <br /> The proposed project will comply with the requirements in the Riparian Habitat Ordinance. <br /> This ordinance requires a developer to protect existing riparian habitat(such as the drainage <br /> Swale habitat at the proposed project site) or mitigate for the loss of the habitat. One method <br /> of mitigation is to contribute to existing off-site riparian habitat areas such as the Mountain <br /> House Creek corridor. Policies related to protection of other sensitive biological resources <br /> (such as special status species) will be addressed through the applicant's participation in the <br /> { SJMSCP. <br /> 4-54 <br />
