The subdivider shall agree to and shall pay user fees for the utility services from the time <br /> improvements are accepted by the County until the lots are placed on the County tax rolls, or up <br /> to an 18-month period, as the case may be. (Subdivision Map Act Section 66493) <br /> r. An Offer of Dedication of ground water rights on the Final Map is required. <br /> s. This development may be subject to reapportionment under San Joaquin Area Flood Control <br /> Agency Assessment District No. 96-1 (Flood Protection Restoration Project). The property shall transfer to a zone within CSA 41 prior to approval of the Improvement Plans to <br /> provide for the operation, maintenance, and improvement of street lighting and storm drainage <br /> facilities. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify and hold harmless the local agency or its agents, officers, and <br /> employees from any claim, action, or proceeding against the local agency or its agents, officers, <br /> or employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body concerning a subdivision, which action is brought within <br /> the time provided for in Section 66499.37 of the Government Code. <br /> Conditions of Approval -4 - PA-0600119 <br />
